A presente contratação se justifica na medida em que a Câmara Municipal de Colorado pretende realizar política pública, promovendo o acesso à informação e a devida publicidade aos atos praticados pelos vereadores. Além disso, sabe-se que o rádio é o equipamento mais democrático de comunicação, visto que é acessível em qualquer lugar, seja no carro, seja no rádio a pilha na zona rural e, inclusive, através dos celulares. Por fim, a referida transmissão deverá ter caráter educativo, informativo ou de orientação social, dela não podendo constar nomes, símbolos ou imagens que caracterizem promoção pessoal de autoridades ou servidores públicos, conforme prescreve o parágrafo 1º do artigo 37 da Constituição Federal, o qual determina que os atos oficiais devam ter publicidade sem promoção pessoal, de modo que a contratação em questão vai de encontro ao referido preceito, já que a transmissão na integra da sessão não irá favorecer ou preterir qualquer vereador na sua atuação parlamentar.
