The provision of funeral services through a paid concession in the municipality is based on the following provisions: Federal Constitution, Article 175: Assigns to the Public Power the responsibility for the provision of public services, and may delegate them through concession. Federal Law No. 8.987/1995: Regulates the concession and permission regime for the provision of public services. LAW No. 14.133/2021: ESTABLISHES PLANNING AS AN INDISPENSABLE STAGE IN PUBLIC PROCUREMENT, REQUIRING A PRELIMINARY TECHNICAL STUDY AND TERMS OF REFERENCE. MUNICIPAL LAW No. 2.476/2025: AUTHORIZES THE ONEROUS CONCESSION OF FUNERAL SERVICES, SETTING A TERM, OBLIGATIONS OF THE CONCESSIONAIRES AND MANDATORY SOCIAL COUNTERPART. Funeral services are of a public utility nature and essential character, requiring organization, oversight, and regulation by the municipal public authority, pursuant to Article 30, item V, of the Federal Constitution, with the municipality being responsible for organizing and providing, directly or under a concession or permit regime, public services of local interest. The decision to grant a concession stems from the need to guarantee continuous service to the population, minimum standardization of services, tariff control, reduction of direct administrative costs to the public entity, and adequate service provision on a permanent on-call basis.
