The subject of the Framework Agreement is the regulation of the procedure for concluding partial purchase contracts (hereinafter referred to as the “Purchase Contracts” or individually as the “Purchase Contract”) (i) for the production and supply of up to 133 (in words: one hundred and thirty-three) pieces of multi-system electric units with a maximum operating speed of at least 160 km/h, fully capable of operation on railway lines with a gauge of 1,435 mm in the territory of the Czech Republic (hereinafter referred to as the “Units” or individually as the “Unit”), including all permits, approvals, consents and registrations (“registration” in the text of the tender documentation means all registrations having a similar character to a permit, approval or consent) which are, according to the legislation, valid on the date of handover of the relevant Unit to the contracting authority and necessary for the operation and use of the supplied Units and which will enable the contracting authority to properly and without restrictions operate and use the Units in the territory of the Czech Republic, and further including technical documentation belonging to the relevant Units to the extent specified in the Framework Agreement; and/or (ii) supplies of spare parts and components of the exchange system (“spare parts of the exchange system”) and (iii) contracts for the repair and maintenance of the delivered Units in the form of Full-Service (hereinafter referred to as the “Full-Service Contract”).
