The contract for the provision of emergency physician staffing for the intensive care transport vehicle (ITW) at the Nordoe rescue station is awarded year-round, Monday through Friday – including public holidays – between 7:00 a.m. and 7:00 p.m. The service consists of providing suitable emergency physicians for intensive care transport by way of personnel secondment, which, in the client's opinion, meets the requirements for a legally permissible temporary employment arrangement as defined by the German Temporary Employment Act (AÜG) (see in particular section 12.1 of the Invitation to Tender). Consequently, the client acts as the hirer and the service provider as the temporary employment agency within the meaning of Section 1 Paragraph 1 AÜG. The emergency physicians deployed are therefore to be classified as temporary agency workers within the meaning of Section 1 Paragraph 1 Sentence 1 AÜG. It is therefore intended to conclude a public-law employee leasing contract (see contract in Annex 2) pursuant to Section 121 of the State Administrative Procedure Act (LVwG). The work will not be divided into lots.
