1. The subject of the Order is the design and implementation of a complete Electric Energy Storage Facility (hereinafter referred to as "MEE") on a turnkey basis (EPC), in particular: preparation of complete and fault-free Documentation, including design documentation, obtaining a Building Permit, delivery of brand new, complete, defect-free and free from damage and use devices constituting the MEE, preparation of the Construction Site, execution of MEE installation works, execution of accompanying works, commissioning of the MEE, execution – if necessary – of modifications to existing devices and infrastructure required for commissioning of the MEE, conducting tests for the required MEE components (FAT/SAT), execution of other installation works, delivery and installation of brand new, complete, defect-free and free from damage and use 400 kV/MV transformer unit(s), integration with the TSO systems and the Ordering Party's systems, obtaining an Occupancy Permit, commissioning of the MEE, obtaining Operator's Permits, training The Ordering Party's operational services, as well as the Removal of Defects during the Warranty Period and the provision of maintenance services (Service) in relation to the MEE. The Contractor undertakes to design and implement the MEE with Guaranteed Technical Parameters, achieving and maintaining the Guaranteed Technical Parameters, which – by meeting the requirements specified in the Agreement and the Legal Provisions in force on the date of signing the Takeover for Operation Protocol – will be capable of fulfilling all intended functions and providing the MEE with Service, as well as fulfilling all other obligations of the Contractor specified in the Agreement. 2.
