The subject of the order is the execution of an investment project concerning the "Construction of a sports, service, and recreation facility at Legionów Avenue/Kościuszki Street in Gdańsk-Wrzeszcz. The subject of the order is divided into two Subject Matters and has three main functions. The building structure along Legionów Avenue will include the following functions: swimming pool and service (Subject Matter I), while the building structure along Kościuszki Street will include the following functions: sports and recreation (Subject Matter II). The subject matter of the order is defined in the Terms of Reference (TSR). The detailed scope of the order and terms of implementation are specified in the DSO, which constitutes an annex to the TTS. Other terms of implementation are specified in the Agreement and the Contract Terms, which constitute annexes to the TTS, respectively. If anywhere in the TTS the subject matter of the order is defined by the indication of trademarks, patents, or origin, the Ordering Party allows for the submission of offers using solutions equivalent to those described. Where the description of the subject matter of the order indicates the origin of the equipment covered by the order, referred to in Article 99, paragraph 5 of the Public Procurement Law (e.g., brand, trademark, manufacturer, supplier), the Ordering Party allows the offering of devices with parameters equivalent to, or higher than, those specified in the description. Equivalence should be understood as ensuring that the equipment will fulfill the order in accordance with the description of the subject of the order and will ensure that technical and quality parameters and warranty requirements are not inferior to those assumed in the aforementioned description. The proper names provided in the descriptions of the subject of the order are intended solely to clarify the Ordering Party's qualitative, technical, and technological expectations.
