1. The subject of the order covers the commissioning and operation of the Zielona Góra City Bike (ZRM) along with associated services, including maintenance and repairs. 2. A detailed description of the subject of the order is included in Annex I.2 to the ToR. 3. The Ordering Party hereby informs that any references to common names, trademarks, manufacturer names, and photographs in the ToR and its attachments may be used solely to define visual, technical, and quality characteristics. Product names, trademarks, patents, or origins used in the ToR and its attachments should be treated as examples – the Ordering Party allows the use of equivalent products (materials, equipment). An equivalent product is considered to have the same functional, visual, material, and technical characteristics as the specific product indicated in the ToR but is marked with a different trademark, patent, or origin. The quality of the equivalent product cannot be inferior to that described in the subject of the order. It cannot in any way lower the standard and cannot change the principles and technical solutions adopted in this ToR, thus depriving the User of any performance, functionality, or usability described or resulting from the ToR. A contractor who adopts equivalent solutions (products) in the quotation is obligated to prove the equivalence of the adopted solutions, including equipment and materials. To confirm that the offered equivalent solution meets the requirements specified in the ToR, the contractor must submit, along with the offer, a detailed description/list of the offered subject of the equivalent order, specifying for each solution the features allowing for the unambiguous identification of the offered solution and confirmation of compliance with the description of the subject of the order.
