The subject of the public procurement contract is the successive deliveries of pharmaceutical products – products for enteral and parenteral nutrition, SOPs (hereinafter referred to as "products" or "subject of the procurement"). A detailed description of the products is set out in the description of the subject of the procurement contract in the Assortment and Price List (hereinafter referred to as "Summary") constituting Appendix No. 2 to the SOPs. The Ordering Party requires that the delivered subject of the procurement contract be approved for trading and use in the territory of the Republic of Poland in accordance with the Act of 6 September 2001 – Pharmaceutical Law (consolidated text: Journal of Laws of 2022, item 2301, as amended), meet the requirements indicated in other applicable specific provisions and standards concerning the subject of the procurement contract, and meet the minimum requirements specified in the SOPs. The Contractor must have documents confirming the above, including medicinal product registration certificates and safety data sheets, and is obligated to provide them to the Ordering Party upon request and at any time. The Ordering Party requires that the delivered product have an expiration date of at least 6 months from the date of delivery. The Ordering Party requires that the delivered product be packaged by the Contractor in a manner that prevents accidental damage and marked in a manner that raises no doubts as to the package contents and in accordance with applicable regulations. The Ordering Party provides for periodic (successive) deliveries of products, according to the Ordering Party's needs, based on "Partial Orders." The required deadline for partial delivery is up to 3 business days from the order placement.
