1. The subject of the order is the delivery of three identical brand new M3 class II category buses with a hybrid drive (MHEV), ranging in length from 12 m to 12.5 m; with a minimum of 60 seats, including at least 45 seats and one wheelchair accessible passenger. These buses meet the Euro 6 emission standard. A detailed description of the subject of the order is attached to the specifications. 2. The project has been submitted for funding under the National Recovery and Resilience Plan; Component E: Green, Smart Mobility; Investment: E1.1.2 Zero- and Low-Emission Public Transport (Buses) [Extra-Urban]. 3. If the description of the subject of the order (Appendix No. 10 to the Specifications) includes the name of the manufacturer or company, the Ordering Party reserves the right to use other equivalent materials, but with parameters no worse than those described in the subject of the order (Appendix No. 10 to the Specifications). 2.1. Pursuant to art. 101 sec. 4 of the PZP, the Ordering Party accepts solutions equivalent to those described in the SWZ using standards, technical assessments, technical specifications and technical reference systems referred to in art. 101 sec. 1 item 2 and sec. 3 of the PZP, if they enable the achievement of features or parameters not worse than those cited. 2.2. Pursuant to art. 101 sec. 5 of the PZP, a Contractor who cites solutions equivalent to those described by the Ordering Party is obliged to prove in its offer that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent degree, by attaching to its offer the relevant evidence referred to in art. 104–107 of the PZP. 2.3. Whenever the SWZ indicates a material trademark, patent, origin, source or specific process that characterizes products or services delivered by a specific contractor, the Contractor may use the indicated or equivalent material that meets the technical requirements indicated by the Ordering Party....
