1. The subject of the order is the delivery of ten new, multi-unit electric multiple units together with a repair package for electric multiple units and training of persons indicated by the Ordering Party in the scope of operating electric multiple units (applies to the basic order). 2. A detailed description of the subject of the order, the requirements and expectations of the Ordering Party are provided in the Sample Agreement (WU-II part of the SWZ) and in the Description of the Subject of the Order (OPZ – III part of the SWZ), which constitute an integral part of the SWZ. 3. The Ordering Party anticipates the possibility of exercising the option right referred to in art. 441 of the Public Procurement Law in the scope of: 1) delivery of up to a maximum of 10 new, multi-unit electric multiple units meeting the requirements specified in the SWZ, in particular in the sample agreement and description of the subject of the order (of the same type and model as the electric multiple units from the basic order), 2) delivery of a repair package for electric multiple units. 4. Acting under art. 139 section 1 of the Public Procurement Law, the Ordering Party informs that it will apply the so-called The "reverse procedure," i.e., it will first examine and evaluate the offers, and then subjectively qualify the contractor whose offer received the highest score, in terms of the absence of grounds for exclusion and compliance with the conditions for participation in the procedure. 5. Pursuant to Article 257 of the Public Procurement Law, the Contracting Authority anticipates the possibility of canceling the procedure if the public funds that the contracting authority intended to allocate to finance all or part of the contract are not awarded to it. 6. The procedure is conducted in Polish using electronic means of communication, i.e. via the Purchasing Platform (hereinafter referred to as the Platform) at https://kd.eb2b.com.pl.
