1. The subject of the contract under Part I is the management (recovery in R processes or disposal D) of unsorted (mixed) municipal waste (code 20 03 01), throughout the entire term of the contract with the selected contractor, in quantities from 2000 Mg to 4200 Mg. 2. Unsorted (mixed) municipal waste should be understood as the types of waste referred to in the regulations on waste and in Art. 9e paragraph 1 item 2 of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (Journal of Laws of 2024 item 399), hereinafter referred to as the "Act on maintaining cleanliness and order in municipalities". 3. The Contractor is obligated to ensure the processing of unsorted (mixed) municipal waste in a municipal installation that meets technological standards enabling the achievement of at least the minimum legally required level of recycling, preparation for reuse, and recovery by other methods, entered on the list referred to in Art. 38b, paragraph 1, item 1 of the Act of 14 December 2012 on Waste (Journal of Laws of 2023, item 1587, as amended), hereinafter referred to as the "Waste Act," and to hold current, legally required permits for the management of unsorted (mixed) municipal waste. 4. The waste processing installations indicated in the offer must comply with legal requirements, in particular the provisions of the Act on Maintaining Cleanliness and Order in Municipalities and the provisions of the Waste Act. 5. The Contractor may manage the waste in its own municipal installation(s) or in municipal installation(s) other than its own with which it has concluded waste management agreements. 6. If the municipal facility indicated in the bid does not accept waste, the contractor is obligated to ensure waste management in another municipal facility at its own expense, including covering the cost of transporting the waste to another municipal facility.
