SUSPENSIVE CLAUSE: “THE PROCEDURE FOR AWARDING THE PUBLIC PROCUREMENT CONTRACT IS INITIATED UNDER THE IMPACT OF THIS SUSPENSIVE CLAUSE, IN THE MEANING THAT THE ISSUANCE OF THE SUPPLY ORDER IS CONDITIONED ON THE SIGNING OF THE FINANCING CONTRACT, RESPECTIVELY ON THE ALLOCATION OF BUDGETARY APPROPRIATIONS FOR THIS PURPOSE, AND THE ISSUANCE OF THE SUPPLY START ORDER, BEING DONE IN COMPLIANCE WITH THE PROVISIONS RELATING TO THE COMMITMENT OF EXPENDITURE FROM THE BUDGETS COVERED BY THE LEGISLATION ON PUBLIC FINANCES. HAVING REGARD TO THE PROVISIONS OF LAW 98/2016 ON PUBLIC PROCUREMENT AND G.G. NO. 395/2016, WITH SUBSEQUENT AMENDMENTS AND SUPPLEMENTATIONS, THE CONTRACTING AUTHORITY SPECIFIES THAT IT WILL ISSUE THE ORDER TO START SUPPLY TO THE SUCCESSFUL TENDERER ONLY TO THE EXTENT THAT THE FUNDS NECESSARY FOR THIS STAGE WILL BE ENSURED BY ALLOCATING BUDGETARY APPROPRIATIONS FOR THIS PURPOSE.
