The contracting authority purchases a maritime patrol vessel in accordance with the provisions of the specifications and the attached technical specifications, and the estimated value of the purchase includes all the activities provided for in the specifications. Pursuant to art. 221 para. (1) let. a) of Law no. 98/2016 on public procurement, the contracting authority uses contract review clauses in the procurement procedure as follows: A. Review clause regarding the replacement of the offered products with state-of-the-art products The contracting authority specifies that it will use the review clause for the delivery of state-of-the-art products in the event that the manufacturer of the initially offered products has declared the initially offered products as end-of-sale/end-of-life/end-of-support during the validity period of the contract. This clause includes all the equipment in the ships' equipment. When applying the revision clause, the value of the contract will not be changed and the replacement proposals will be analyzed by the contracting authority so that the technical specifications of the newly proposed products are equivalent to or superior to the technical specifications of the products initially offered. B. Suspensive clause: The procurement procedure is initiated under the incidence of this suspensive clause, in the sense that its development and the signing of the contract are conditional on obtaining approvals from the management authority (financing authority) regarding the extension of the financing contract as well as the supplement of the budget necessary to cover the changes in the VAT rates.
