Legal services are almost always bought through a panel rather than a single appointment, because a public body needs different specialisms at unpredictable times. The tender establishes lots by area of law -- property, employment, procurement, litigation, corporate, regulatory -- and admits several firms to each. Winning a place confers the right to receive instructions, not a volume of work, and the real competition continues afterwards through the allocation rules, which the tender documents usually set out and bidders usually skim.
Rates are the visible term and the least reliable guide to cost. Panels are let on hourly rates by grade, but buyers increasingly require fixed or capped fees for defined pieces of work, fee estimates that cannot be exceeded without authority, and transparency on the grade mix actually used. Disbursements, counsel's fees and the treatment of travel and administrative time are where the difference between a quoted rate and a delivered bill usually appears, and the sharper tenders specify them.
Conflicts and continuity determine who can serve. A firm acting for a counterparty is conflicted out, and for a public body with many commercial relationships that happens often enough that panels are deliberately built with alternatives in every lot. Named relationship partners, continuity of the individuals who know the buyer's business, and the supplier's ability to hold institutional knowledge across a panel term are scored. Value-added commitments -- training for in-house teams, secondments, knowledge portals -- are offered routinely and should be read as contractual obligations, because buyers now measure them.
