Almost every building contract in this category is let one of two ways, and the notice usually says which in a single line that decides whether a firm can bid at all. Under a traditional route the buyer has already had the building designed and asks contractors to price that design, normally against a bill of quantities; competition is on price and programme and the design risk stays with the buyer. Under a design and build route the contractor takes on the design as well, so the bid team needs designers under contract before submission and the evaluation weights a proposed design as much as a price.
Prequalification is where most of the exclusion happens. Buyers ask for completed projects of comparable value, sector and complexity, audited accounts showing turnover at a multiple of the contract value, professional indemnity and contract works insurance at stated limits, and an accident and enforcement history. Bid bonds at tender and a performance bond at award are standard, as is retention held against practical completion and released only after a defects liability period. These requirements are why a capable regional contractor often bids as part of a joint venture rather than alone.
Once on site the terms that matter are dated rather than technical. Sectional completion, liquidated damages running per week of delay, extension of time provisions and the mechanism for valuing variations govern the outcome far more than the specification does. Public buyers increasingly add obligations that are scored and then audited: apprenticeships and local labour, supply chain payment terms, waste diversion and embodied carbon reporting. They are contractual commitments, not narrative, and they are measured.
