By resolution of February 3, 2025, the Municipal Council approved the principle of using a public service delegation (DSP) contract, in accordance with the provisions of Articles L. 1411-1 et seq. of the General Code of Local Authorities and Articles R. 3126-1 et seq. of the Public Procurement Code. The relationship between the concessionaire and the City of Annecy will be governed by a Public Service Concession Contract, as defined by Articles L. 1121-1 of the Public Procurement Code and L. 1411-1 of the General Code of Local Authorities. The form of the delegation chosen by the delegating authority is that of a lease. The concessionaire will be responsible for carrying out all public service missions related to the operation of a daycare center under the conditions defined in the lease agreement. The concessionaire will manage this facility at its own risk and under its full responsibility. The Municipality provides the concessionaire with the premises and equipment defined in the concession agreement. The concessionaire must, by appropriate means, ensure the continuity of service and equal access to this public service. The concessionaire undertakes to comply with all legal and regulatory provisions applicable to the delegated activity. The estimated value of the contract is €1,700,000 including VAT. The estimated value is calculated in accordance with the provisions of Articles R. 3121-1 to R. 3121-4 of the French Public Procurement Code, and takes into account the total estimated turnover over an operating period of 4 years and 249 days, based on a calculation in constant euros, without indexation or discounting.
