France – Water distribution and related services – CONCESSION POUR L'EXPLOITATION DU SERVICE PUBLIC DE L'EAU POTABLE

Through this procedure, the municipality of Beaugency wishes to entrust the future concessionaire with the exclusive responsibility for managing the public drinking water production and distribution service, which notably includes: - The exclusive right for the concessionaire to provide the public drinking water production and distribution service to subscribers within the designated area; - The obligation for the concessionaire to manage the service's relationship with subscribers (welcoming users, implementing the social policy decided by the municipality, etc.); - The obligation for the concessionaire, for the duration of the contract, to operate the service's facilities and installations in accordance with applicable regulations and to ensure their operation, monitoring, upkeep, maintenance, and renewal; - Maintenance work on the facilities and pipelines; - Renewal of rotating equipment, hydraulic accessories, electromechanical equipment of the installations, and connections; - Maintaining up-to-date plans and the technical inventory of fixed assets; - The concession holder's obligation to provide the local authority with information, advice, opinions, and warnings on all matters concerning the proper operation and overall quality of the service, and for the development of its reinforcement and expansion projects; - The obligation to collect, on behalf of the various relevant organizations, from subscribers of the concessioned service, in consideration of the service provided, the sums corresponding to the following pricing elements: o The concession holder's share; o The local authority's share; o Additional water charges and fees allocated to public bodies; o Taxes, fees, or contributions that the concession holder may be required to collect from subscribers as a result of decisions imposed upon it; - The concession holder's right to collect from subscribers the fees corresponding to the services it provides.
