The subject of the order is the preparation of 8 pieces of documentation on the assessment of ground surface contamination in order to confirm or exclude the occurrence of historical ground surface contamination and to confirm or exclude the occurrence of environmental damage in accordance with the Regulation of the Minister of the Environment of 1 September 2016 on the method of conducting the assessment of ground surface contamination (Journal of Laws, item 1395, as amended), containing the results of tests performed by an accredited laboratory referred to in art. 147a, paragraph 1, item 1 or paragraph 1a of the Act of 27 April 2001 - Environmental Protection Law (consolidated text: Journal of Laws of 2024, item 54, as amended). The detailed scope of the subject of the order is specified in Appendix No. 1 to the ToR – Description of the Subject of the Order (ToR). Other conditions regarding the performance of the order are specified in the "Draft Contract Provisions" (ToR), constituting Appendix No. 2 to the ToR. Requirements related to the performance of the contract regarding the employment by the Contractor or subcontractor on the basis of an employment relationship of persons performing activities indicated by the Contracting Authority within the scope of the contract, if the performance of such activities consists in performing work in the manner specified in Art. 22 § 1 of the Act of 26 June 1974 - Labor Code (Journal of Laws of 2023, item 1465, consolidated text): The Contracting Authority does not specify any requirements. The Contracting Authority anticipates the possibility of invalidating the proceedings in question, pursuant to Art. 257 of the Act (if the public funds that the Contracting Authority intended to allocate to finance all or part of the contract are not awarded to it).
