Energy notices cover three different transactions that a bidder should separate before responding. The first is supply: a contract to deliver electricity or gas to meter points, priced as a unit rate with standing charges, awarded for a term and increasingly specified by generation source. The second is generation or connection assets -- plant, substations, heat networks, storage -- which is capital works with commissioning and grid connection at its centre. The third is performance-based efficiency work, which is a financing structure as much as a construction one.
Supply contracts turn on when the price is fixed. Buyers may take a fixed price for the whole term, fix in tranches as the market moves, or buy flexibly against a wholesale index with a supplier managing the purchasing, and the tender states which. Each puts the price risk in a different place, and comparing bids across mechanisms is not possible without modelling them on a common basis. Where renewable or low-carbon content is required, buyers now ask for certificate-backed evidence rather than a description of the supplier's generation mix.
Performance contracting deserves its own reading. In these arrangements the supplier designs and installs measures -- lighting, controls, heat generation, fabric -- and is paid from the savings, sometimes with a guarantee that underwrites them. The whole contract then rests on the measurement and verification protocol: the agreed baseline, the adjustments for weather and occupancy, and who measures. Bidders and buyers who negotiate the technology before the measurement protocol usually end up arguing about the measurement protocol.
