Registration, quality assurance and the shape of a medicines contract
A medicines tender is decided on quality assurance before it is decided on price. Bidders must show that the product is authorised or registered for use in the destination market, that it is manufactured at a site holding current good manufacturing practice certification, and -- for many donor-funded and essential medicines programmes -- that the product or its manufacturer appears on a recognised prequalification list. These are documentary conditions of admissibility assessed against the specific product and manufacturing site offered, and a change of site after award is a contractual event, not an administrative one.
Products are specified by international non-proprietary name, strength and dosage form so that generics compete openly, with pharmacopoeial standards cited for quality. Delivery conditions carry as much weight as the product: a minimum proportion of shelf life remaining on arrival, batch certificates of analysis, tamper-evident and correctly labelled packaging in the required language, and unbroken cold chain with temperature monitoring for products that need it. A consignment that arrives with too little shelf life left is routinely rejected at the buyer's cost to the supplier.
The commercial structure is usually a framework at agreed unit prices with call-offs against forecast rather than firm volume, because demand depends on disease patterns and programme funding. That places emphasis on lead times, on the supplier's obligation to hold or replenish stock, and on what happens in a shortage -- allocation, substitution and notification terms are increasingly explicit. Recall capability is tested rather than assumed: buyers ask how quickly a batch can be traced and withdrawn from every facility it reached.
